Terms of Service

These terms govern your use of the Asta Auction app and website. Bidding at any auction
is additionally governed by our Rules of Auction (V.08-26),
which you accept when you register as a bidder and which take precedence on anything
concerning an auction itself.
Registering as a bidder
- You must be 18 or older and provide accurate information.
- You must complete FICA verification before you may bid. We may decline a registration.
- You are responsible for everything done under your account. Keep your password private.
Bidding
- Every bid is a firm, binding offer to buy at that amount. Bids cannot be retracted once
the lot closes.
- Lots are sold voetstoots — as is, where is — with no warranty as to condition or
fitness for any purpose. Inspect before you bid.
- A lot may carry a reserve. If the reserve is not met the sale is subject to the seller's
confirmation.
- Bids are exclusive of VAT, the buyer's premium and, on property, transfer duty. Wait for
our pro-forma invoice rather than calculating a total yourself.
Deposits and payment
- A refundable registration deposit may be required before you can bid on a lot.
- Payment is by EFT into our trust account. We do not accept cards or cheques.
- Nothing is treated as paid until the funds reflect in our trust account, and no asset is
released before the invoice is settled in full.
- If you are unsuccessful, your deposit is refunded to the account you nominated, within the
period stated in the Rules of Auction.
If you do not pay
Failing to settle after winning is a breach. Your deposit may be forfeited towards the
costs set out in the Rules of Auction, and we may refuse you registration at future auctions.
Our role
We act as auctioneer on behalf of the seller. Disputes about the goods themselves lie
between you and the seller, except where our own negligence caused the problem.
Ending your account
You may delete your account from within the app at any time. We may suspend or close an
account that breaches these terms or the Rules of Auction.
Governing law
These terms are governed by South African law, and you consent to the jurisdiction of the
South African courts.
